Instinct Holistic Medical Spa Terms & Conditions
Thank you for choosing Instinct Holistic Medical Spa. By purchasing any package, product, or service from us, you agree to the following terms and conditions:
No-Shows and Late Cancellations
This Payment Consent Agreement (“Agreement”) outlines the cancellation policy and payment terms for services provided by Instinct. By signing this Agreement, you acknowledge and consent to the following terms:
Cancellation Policy:
- Cancellation Window: Instinct enforces a 48 -hour cancellation policy. Appointments canceled with less than 48 hours notice or missed without notice will be subject to a no-show fee.
- Late-Cancelled Appointment Fee: If you cancel your appointment within the 48-hour window before the scheduled appointment time, you agree to pay a late-cancelled appointment fee equal to 100% of the missed appointment value up to a maximum of $150 or $300 for appointments booked with a Doctor, NP, or PA; For appointments booked to redeem package vouchers or membership credits, missed appointments will lose the voucher of one service credit from a package or the equivalent value from the membership.
Payments
- Payment Information:
- Secure Payment Storage: We will securely and confidentially store your payment information using Boulevard, our booking, scheduling, and payment software.
- Future Transactions: You understand and consent that your payment information will be saved for future transactions, including but not limited to deposits, membership purchases billed over time, or any transaction(s) related to goods or services on a prearranged, recurring billing schedule.
- Payment Authorization:
- Authorization to Charge: You acknowledge and authorize Instinct to charge your credit card on file in the event of a no-call/no-show for an appointment or for any appointment rescheduled or canceled within the 48-hour late-cancellation window, as outlined in this Agreement.
Booking and Scheduling Policy
- Appointments can be booked online, via phone, or in person. We recommend booking at least 2 weeks in advance to secure your preferred time. Same-day appointments may not be guaranteed.
Arrival Policy
- Please arrive 10 minutes prior to your scheduled appointment. Late arrivals may result in shortened services or rescheduling, at the discretion of the spa. Full charges will apply.
Payment Methods
- We accept all major credit cards, cash, and gift certificates. Payment is due at the time of service. Package and service purchases must be paid in full upfront.
Price Changes
- Instinct Holistic Medical Spa reserves the right to adjust prices at any time. Pre-purchased packages will maintain the purchased value as outlined below in the Package Purchase Terms.
Gratuity Policy
- Gratuities are not included in service prices. A 15-20% gratuity is customary and appreciated.
Promotions and Discounts
- Promotional offers cannot be combined with other discounts or applied to previously purchased services or packages.
Membership Terms
- Memberships include access to special discounts and monthly services. Membership fees are non-refundable, and services must be used within the membership period.
Package Purchases
- All package purchases are non-refundable, except within the first 10 days of purchase. Refunds requested within this 10-day period will be processed with a 10% service fee deducted from the total refund amount.
- Activated packages, where any service has been used, are ineligible for a refund.
- Customers who are not satisfied with the services included in their package may convert unused service credits (minus the value of the package discount applied for used service credit) into account credit, which can be applied to other services, packages, gift certificates, or products purchased at current prices.
- Package credits must be used within 6 months of purchase. After this period, any remaining dollar value from unused credits (minus the value of the package discount applied for used service credit) will be converted into account credit to be used on packages, services, gift certificates, or products purchased at current prices.
- Packages and service credits are non-transferable and must be used by the original purchaser.
Service Purchases
- All service purchases are final and non-refundable, except in cases of extenuating circumstances, which will be reviewed on a case-by-case basis. Extenuating circumstances may include serious medical conditions or other verifiable unforeseen events, subject to management approval.
Product Purchases
- Unopened products are eligible for a full refund within 10 days of purchase. The refund will be returned to the original form of payment used for the product purchase or exchanged for store credit.
- Opened products are non-refundable unless there is a proven allergic reaction. In the case of an allergic reaction, we will work with the product manufacturer to find a suitable replacement.
Gift Certificates
- Paid Amount of gift certificates do not expire and are non-refundable, in compliance with Montana state law. Any bonus gift certificate value acquired during a sale or in a giveaway has no cash value and expires 1 yr from the date of issue. Gift Certificates must be presented at the time of service and may not be exchanged for cash except in the case of a remaining value under $5, which can be requested as a cash refund. Any gift certificate with a balance over $5 can be used for future purchases.
Liability Waiver
- By booking a service, you acknowledge that spa treatments carry inherent risks, and you release Instinct Holistic Medical Spa from any liability for personal injury or unsatisfactory results.
Allergies and Adverse Reactions
- Clients are responsible for informing the spa of any known allergies prior to service. The spa is not liable for adverse reactions due to undisclosed allergies.
Health & Safety Policies
- If you are feeling unwell or showing signs of illness, please reschedule your appointment to protect the health of our staff and other clients. We reserve the right to refuse service to anyone who is visibly ill.
Right to Refuse Service
- We reserve the right to refuse service to anyone for any reason, including but not limited to inappropriate behavior or failure to comply with our policies.
Privacy Policy (Credit Card Security & Compliance)
- We take your privacy and security seriously. Personal information, including credit card details, is encrypted and stored in compliance with **PCI DSS (Payment Card Industry Data Security Standard)** requirements. Stored credit cards are securely managed, and we do not share this information with third parties, except as required by law. You can request to have your payment information removed from our system at any time.
Force Majeure
- Instinct Holistic Medical Spa is not liable for any service interruptions caused by unforeseen events such as natural disasters, pandemics, or government restrictions.
Dispute Resolution
- Any disputes arising from this agreement will first be attempted to be resolved through mediation. If mediation fails, disputes will be settled through binding arbitration.
